Excerpt from Seven Letters to the Lords and Commons of Great Britain: Upon the Impolicy, Inhumanity, and Injustice of Our Present Mode of Arresting the Bodies of Debtors Shewing the Inconsistency of It, With Magna Carta and a Free Constitution It will doubtless be deemed by some, presumption in an individual, and not of the possession, to attempt to write, or say, any thing upon the subject of the Law: but all good men, I am persuaded, will forgive my boldness, when they are convinced, that humanity to my fellow creatures, and jealousy for the honour of my country, are my springs of action. For this, I have dared to tread upon ground, where I must expect to be roughly handled, by the champions for the present mode of Arrests ; because it is made so very profitable to such numbers of the profession. Where so much advantage accrues by any practice, there will not be found wanting, numbers who will find arguments to vindicate it, Whether those arguments can be supported by found policy, justice, truth, time must discover. It plainly appears to me, and, I trust, it will to a majority of those to whom the following Letters are addressed, that the present practice of arresting and imprisoning the bodies of Debtors, in the first instance, before any debt is proved, cannot be defended upon the above principles.
