Arrington, for Plaintiff in Error There are two great questions in this case. The first relates to the jurisdiction of the court; and the second to the mode of proceeding. The two questions, though, in the present instance, closely connected, are legally very different in their character. I shall treat these questions in their order. First. The Jurisdiction. In the outset, it may be assumed as an axiom, that the jurisdiction of any court in a given case depends upon some fact; and consequently, that such fact is the criterion of jurisdiction in the case. But it is manifest that the jurisdiction can only be inferred from the particular fact, by logical combination with a general principle serving as a major premise. What then, is the general principle, or rule, for admiralty jurisdiction in cases of tort? And the books, English and American, answer "Locality." "In torts, locality ascertains the jurisdiction."
