Excerpt from In the United States Circuit Court of Appeals for the Ninth Circuit, Vol. 9 (Testimony of W. H. Metson.) Q. Mr. Metson, upon the proceedings in the matter of the alleged contempt of Dudley Dubose, I will ask you if these questions were not asked you, and if you did not make these answers. I am reading from page 120 of the printed record of the testimony, taken before the Hon. E. H. Heacock, United States Commissioner: "Q. You had already applied to the United States marshal to enforce the writ, and he refused to do so. "A. Yes, sir. "Q. He told you he would not enforce the writ, because in his opinion the writ was not addressed to him? "A. Yes, sir; and he did not like to take the responsibility inasmuch as he was not specifically mentioned in the writ as the officer to enforce it." Do you recall that? A. I think that is pretty near my recollection now. I think that in substance occurred on the morning of the 11th of September, 1900. Mr. Heney. - We will offer those questions and answers in evidence. Q. And the following question and answer: "Q. After the marshal refused to aid you, you proposed then to enforce the writ yourself? A. Yes, sir. "Q. Without the aid of any officer? "A. I intended to enforce that writ, if the military did not interfere, if I could." A. That was my intention. I think that was about right. Mr. Heney. - We offer those two questions and answers.
