Excerpt from Practice on Appeal From the Municipal and City Courts of the City of New York: To the Appellate Term and Appellate Division of the Supreme Court Since the creation of the Appellate Term as the forum for the hearing and determination of appeals from the City and Municipal Courts of the City of New York the work of that Court has been constantly increasing until it has reached very large proportions. The total number of appeals heard in 1899 was four hundred ninety-five, while in 1905 one thousand one hundred and sixty-six were heard and determined. The number of calendar motions last year was six hundred and two, and this does not include motions heard and decided during recess. A proportionately similar condition exists in the Appellate Division of the Second Department where appeals from the Municipal Court are heard. For these reasons there has long been recognized the necessity for a work on the practice in the Appellate Term of the First Department and on practice affecting appeals taken to the Appellate Division in the Second Department. This book has been compiled in the hope that it might supply such a need. The object of this work is to afford a guide to the practitioner after an appeal has been taken, rather than to instruct him in the preparation of the record in the court below. (A work of much merit has recently been published, viz.: "Seabury on City Court Practice," to which the reader is referred for the necessary steps to be taken in that court for preparing and serving a case on appeal, amendments thereto, etc. It is the intention of the authors of this work to shortly publish a text-book [which is now in the course of preparation] upon "Practice in the Municipal Court of the City of New York," which will contain a reference to the necessary steps to be taken in that Court to perfect an Appeal from the Municipal Court to the appropriate appellate tribunal.)
