Excerpt from History of the Judiciary of Massachusetts: Including the Plymouth and Massachusetts Colonies, the Province of the Massachusetts Bay, and the Commonwealth In the preparation of this work I have gathered fragments before published by me, and woven them with new material into a continuous narrative. I have ventured to add, with some doubts of its pertinence, an introductory chapter, reminiscent in character, which I hope may not be without interest. Judge Emory Washburn published in 1840 a Judicial History of Massachusetts, omitting the judiciary of the Plymouth Colony and of the Commonwealth, the seed and flower of the Massachusetts judicial system, and limiting the scope of his investigations to the Colony and Province of Massachusetts Bay. The present work includes not only the material thus omitted by him, but also much new material within the field covered by his valuable history. The Great Charter of New England, the Patent issued by the Council for New England to the Plymouth Colony in 1621, the Patent issued by the Council to the Plymouth Colony in 1629, the Charter of the Massachusetts Colony, the Charter of the Province of Massachusetts Bay and the Charter explanatory of the same, are placed in an Appendix, where, while convenient for reference, they will not disturb the current of the historical narrative. While I shall be held justly responsible for some of the imperfections, which will doubtless be found in my work, there are others for which defective records are alone accountable.
