Excerpt from Manual for Probation Officers in New York State This manual is intended for ready reference by probation officers, and for the information of other persons, including those desiring to become probation officers. It has been prepared because of the large number of inquiries received from various sources by the State Probation Commission concerning the use of probation, the appointment, duties, powers and methods of probation officers, and various other aspects of probation work. Probation officers are public officers, upon whom devolve important responsibilities. They should understand and observe all the provisions of law relating to their work. Although the probation laws are for the most part simple, it has seemed wise in preparing this manual to explain and discuss many of the provisions in detail. Wherever the probation laws or related laws have been construed by the higher courts or by the Attorney-General, their opinions have been quoted or followed; otherwise, all explanations and comments are based on the Commission´s own understanding of the laws. It is not enough, however, for probation officers to understand and obey the letter of the law. Probation calls in a marked degree for human sympathy, a tactful manner of approaching and striving to influence persons on probation, and practical skill in dealing with all kinds of social conditions. Probation is fast becoming a profession with a growing fund of technical knowledge which must be drawn upon by probation workers if they expect to succeed. Much of the space in this manual is therefore devoted to a discussion of methods as distinguished from the strictly legal aspects of the subject. We recognize that no set rules can be followed in every probation case; each delinquent under investigation or on probation has his individual characteristics and circumstances that make it necessary for the probation officer to use wide discretion in adapting his methods to the particular needs. It is hoped, however, that the recommendations and suggestions in this manual, although not adapted to every case, will at least stimulate probation officers to do their work thoughtfully.
