Excerpt from A Digest of the Law of Carriers of Goods and Passengers by Land and Internal Navigation This work is an attempt to reduce the statute and case law of carriers by land into a code or series of articles. The writer originally intended to confine the articles themselves entirely to principles, and to make a scientific treatise on this particular branch of the law of bailments; but he found that to carry out this principle strictly would be to make the work far less useful to those interested in the law relating to the transit by railway of merchandise and passengers, and therefore it is that many of the articles, though important in themselves, are only examples of a principle contained in a previous article. To this extent the writer has laid himself open to the objection of not having given effect to the dictum of Lord Mansfield, set out on the title page of the book. For the same reason, in many of the articles dealing with statutory enactments, the verbatim words of the Act of Parliament are set out instead of the effect of them. Whether this branch of mercantile law is capable of codification is a matter upon which there must be a diversity of opinion. If codification is ever thought feasible or desirable, the writer is ambitious enough to hope that this Digest may afford facilities for that operation.
