R. 4996; To Provide That No Federal Educational Funds May Be Obligated or Expended to Any State or Local Educational Agency Which Discriminate Against Any Meetings of Students in Public Secondary Schools Who Wis The subcommittee met, pursuant to call, at 1 p.m., in room 2175, Rayburn House Office Building, Hon. Carl D. Perkins (chairman) presiding. Members present: Representatives Perkins, Hawkins, Boucher, Ackerman, Hayes, Goodling, Packard, Gunderson, Bartlett, Nielson, and Chandler. Staff present: John F. Jennings, majority counsel; Nancy Kober, legislative specialist; and Richard DiEugenio, Republican senior legislative associate. [Text of H.R. 4996 follows:] [H.R. 4996, 98th Cong., 2d sess.] A Bill to provide that no Federal educational funds may be obligated or expended to any State or local educational agency which discriminates against any meetings of students in public secondary schools who wish to meet voluntarily for religious purposes. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That this Act may be cited as the "Religious Speech Protection Act." Sec. 2. No funds appropriated to the Department of Education to provide financial assistance to State or local educational agencies may be obligated or expended to any State or local educational agency, if the State or local educational agency, or any public secondary school for which the State or local educational agency is responsible, violates the prohibition described in section 3. Sec. 3. It shall be a policy subject to the penalties in section 2 for a public secondary school receiving Federal financial assistance, which generally allows non-school-sponsored groups of students to meet, to discriminate on the basis of the religious content of the speech at such meetings, if - (1) the meeting is voluntary and student initiated, (2) there is no sponsorship of the meeting by the school, government, or its agents or employees, and (3) no activity which is in and of itself unlawful is permitted. Sec. 4. Nothing in this Act shall be construed to permit the United States or any State or political subdivision thereof to - (1) influence the form or content of any prayer or other religious activity; (2) require any person to participate in prayer or other religious activity; or (3) expend public funds beyond the cost of providing the meeting space for student initiated meetings. Sec. 5. The provisions of this Act shall supersede all other provisions of Federal law that are inconsistent with the provisions of this Act.
