Mike Synar (chairman of the subcommittee) presiding. Present: Representatives Mike Synar, Karen L. Thurman, John L. Mica, and Bernard Sanders. Staff present: Sandra Z, Harris, staff director; Sheila C. Canavan, professional staff member; Ruth Fleischer, counsel; Elisabeth R.Campbell, clerk; and Charli E. Coon, minority professional staff, Committee on Government Operations. Opening Statement Of Chairman Synar Mr. Synar. The subcommittee will come to order. In 1980, in the wake of Love Canal and other hazardous wastesite horror stories, Congress enacted the Comprehensive Environmental Response, Compensation, and Liability Act, commonly known as Superfund, to protect the public from releases of hazardous substances into the environment. The Superfund law authorizes EPA to compel potentially responsible parties [PRPs], to clean up contaminated sites or to reimburse EPA for its cleanup costs. The law also created a trust fund financed primarily by fees on industry to pay for site assessments and for cleanup at sites where PRPs could not be identified or were unable or unwilling to pay. The goal of the program was praiseworthy, but its implementation, very candidly, has been nothing less than a bureaucratic nightmare. There currently are 1, 195 sites on the Agency´s national priorities list of sites to be cleaned up. Astronomical costs and significant cleanup delays have plagued the program since its inception. Thirteen years into the program, over $6 billion in trust fund moneys has been spent. The cost to the private sector for conducting actual Superfund cleanup and paying for legal fees and associated Superfund costs has been much more.
