Excerpt from Irrigation District Laws of Oregon: 1919 Irrigation District May Be Organized. Section 1. Whenever fifty or a majority of the owners of land irrigated or susceptible of irrigation desire to provide for the construction of works for the irrigation of the same, or desire to provide for the reconstruction, betterment, extension, purchase, operation or maintenance of works already constructed, or for the assumption as principal or guarantor of indebtedness on account of district lands to the United States under the federal reclamation laws, they may propose the organization of an irrigation district under the provisions of this chapter by signing a petition therefor and presenting the same to the county court of the county in which the land, or the greater portion thereof is situated; said petition shall set forth and particularly describe the boundaries of the proposed irrigation district and shall state that it is the purpose of the petitioners to organize an irrigation district under the provisions of this act, and shall pray that the same be organized hereunder. The petitioners shall accompany the petition with a good and sufficient bond, to be approved by the county court, in double the amount of the probable cost of organizing such district, conditioned that the bondsman will pay all the said costs in case said organization be not effected. Such petition shall be presented at a regular meeting of the county court, or at any special meeting called to consider and act upon the same, and shall be published once each week for at least four successive weeks before the time at which the same is to be presented, in some newspaper printed and published in the county where said petition is presented, together with a notice stating the time of the meeting at which the petition will be presented, and if any portion of such proposed district lies within another county or counties, then said petition and notice shall he published in a newspaper published in each of said counties in the same time and manner. (Laws 1917, Chap. 357, page 744.) Hearing of Petition by County Court. Section 2. When such petition is presented, the county court shall hear the same and may adjourn such hearing from time to time, not exceeding four weeks in all, and on the final hearing may make such changes in the proposed boundaries as the court may find proper, and shall establish and define such boundaries; provided, that no incorporated city or town or platted subdivision or part thereof adjacent thereto chiefly valuable for residence purposes shall be included in an irrigation district; but this proviso is expressly limited to residence property; and all lands, whether wholly or partially within any incorporated city or town, used or suitable for agricultural or horticultural purposes and not platted in tracts of less than one acre, may be included; provided, that said court shall not modify said boundaries so as to except from the operation of the act any territory within the boundaries of the districts proposed by said petitioners which is susceptible of irrigation by the same system of works applicable to other lands in such proposed district; provided that any person whose lands are susceptible of irrigation from the same system of works may in the discretion of the court, upon written application of the owner of said land, have such lands included in said district.
