The same mistake is made here as with regard to numerous other questions of International Law. Authors belonging to different nations approach these questions biased by views of their national legislation and their national jurisprudence. They take it for granted that the principles and rules of International Law are to be construed and interpreted according to views upheld by their Municipal Law and their national jurisprudence.
