Excerpt from The Project Relative to a Court of Arbitral Justice: Draft Convention and Report Adopted by the Second Hague Peace Conference of 1907 The meeting of an Advisory Committee of Jurists at The Hague, June 16-July 24, 1920, to draft a plan for a Permanent Court of International Justice, at the request of the Council of the League of Nations, suggests the advisability of publishing the Draft Convention with the Report adopted by the Second Hague Peace Conference in 1907, for the establishment of a Permanent Court of International Justice under the name and title of "A Court of Arbitral Justice." Mr. Elihu Root, then Secretary of State of the United States, instructed the American Delegation to that memorable gathering "to bring about in the Second Conference a development of the Hague tribunal into a permanent tribunal composed of judges who are judicial officers and nothing else, who are paid adequate salaries, who have no other occupation, and who will devote their entire time to the trial and decision of international causes by judicial methods and under a sense of judicial responsibility. These judges should be so selected from the different countries that the different systems of law and procedure and the principal languages shall be fairly represented. The court should be made of such dignity, consideration, and rank that the best and ablest jurists will accept appointment to it, and that the whole world will have absolute confidence in its judgments." As a result of these instructions, Mr. Choate, Chairman of the American Delegation, proposed the establishment of such a court. The American, the British, and the German delegations presented a joint project which, with various modifications and with the unwavering support of the French Delegation, was eventually adopted.
