He has endeavoured to produce a composition, which, without disgusting the professional reader, may be easily comprehended by men of business, and serve as an elementary treatise to the student. In executing this plan, he has given, under each division, an historical deduction of the opinions which have been held on the point immediately under discussion, and concluded with the law as settled by the latest decisions, where, in fact, it has been settled. Where the point remains still in doubt, he has stated the arguments on both sides of the question. How far he has succeeded in the execution, the public only can decide.
