Excerpt from A Treatise on Civil Imprisonment in England: With the History of Its Progress, and Objections to Its Policy, as It Respects the Interest of Creditors, and the Punishment, or Protection of Debtors, Concluding With the Principles and General Lines of a Plan for Amending the Present Law; And an Appendi From some late discussions it would seem that the present laws of arrest upon actions, and of imprisonment for debt, are yet considered by many as, upon the whole, productive of general good consequences. The author of this treatise, which was written upwards of two years ago, has therefore been induced to publish it. He has endeavoured to place the subject in all the different points of view of which it was susceptible; and might have added a regular plan for amending that branch of the law, which his inquiries and reflections had enabled him to form. - But, in the present mode of communication, he has thought it more becoming to offer only the principles and general ideas on which that plan proceeds. These will be found in the concluding chapter. Its objects are, by means, of a plain and practical course of proceeding, to render imprisonment for debt more beneficial to the fair creditor; and less oppressive to the honed debtor.
