As a consequence, the number of persons permanently or temporarily resident out of the jurisdiction of our Courts, whose evidence is necessary for the purposes of English litigation, is daily becoming larger, and applications to do what is known in general terms as u take evidence on commission" have grown accordingly. Hitherto there has existed no work dealing exclusively with this subject, the law and practice as to which have been found - when they could be found - scattered through the various authorities and text books.
