Excerpt from The Privilege of Religious Confessions in English Courts of Justice Considered, in a Letter to a Friend My Dear Sir, As the question whether a Catholic Priest, or a Protestant Clergyman, may refuse to give evidence in a Court of Justice, respecting matters which have been revealed to him in a religious confession, has lately been raised in Parliament, and elsewhere, I think it right to state my reasons for the opinion which I gave you some time ago, that he may and ought to do so. I feel most sensibly the disadvantages under which I must fulfil my task, after the strong declarations of the Lord Chancellor and Lord Chelmsford, made on the 13th of May last, in the House of Lords, in answer to a question put by Lord Westmeath, at variance with my opinion.
