Excerpt from Annual Report of the Attorney General of the United States: For the Year 1899 Of this number, 531 were disposed of during the October term, 1898, of which 529 were on the appellate and 2 on the original docket, leaving undisposed of at the close of the October term, 1898, 308 cases, of which 304 were on the appellate and 4 on the original docket. The number of cases actually considered by the court was 468, of which 255 were argued orally and 213 submitted on printed arguments. Of the 529 appellate cases disposed of, 294 were affirmed, 61 reversed, 65 dismissed, 39 settled by the parties and dismissed, in 8 questions certified were answered, and 62 were denials of petitions for writs of certiorari under the act of March 3, 1891. The total number of cases on the appellate docket in which the United States was a party or had a substantial interest disposed of at the October term, 1898, was 77. The United States was appellant, etc., in 34 of these cases, and appellee, etc., in 43, and 8 cases were certifications of questions by the circuit court of appeals. Of the 34 cases appealed, etc., by the Government, 4 were decided in its favor and 15 adversely; 12 cases were dismissed by it, 1 was dismissed per stipulation, and 2 were dismissed by the court. In addition, in 6 cases in which questions were certified, 3 were answered in favor of the Government, 3 adversely. Of the 43 cases in which the Government was appellee, etc., 21 were determined in its favor and 9 adversely, 1 was dismissed by the appellant, 4 were dismissed by the court for failure of the appellant, etc., to comply with the rules, 3 were docketed and dismissed, 3 were dismissed per stipulation, and 2 were dismissed by the court. Of the above 77 cases, 29 were appeals from the Court of Claims, of which 19 were taken by the Government. Of the 19 cases so appealed, 1 was decided in favor of the Government and 7 adversely, 10 were dismissed by it, and 1 was partly in favor of and partly against the United States, while of the 10 cases in which it was appellee, 7 were decided in its favor, 2 adversely, and 1 was docketed and dismissed. Of the 77 cases disposed of 13 were criminal, of which 4 were decided in favor of the United States and 6 adversely, 1 was dismissed by the court for failure of the plaintiff in error to comply with the rules, and 2 were dismissed by the court. Five of these 13 criminal cases were capital, of which 2 were decided in favor of the United States and 3 adversely. Eight cases were appeals, etc., from the circuit court of appeals, of which 2 were decided in favor of and 1 against the United States, 4 were dismissed per stipulation, and 1 was dismissed by the court. Seven cases were from the Court of Private Land Claims, 1 of which was appealed by the Government and 6 by the other side.
