Excerpt from The Confiscation Act of 1861, for the Seizure and Condemnation of Property Used for Insurrectionary Purposes, as Prize of War: Brief in the Cases of the United States Vs, Clark´s Foundry The property to be confiscated under this act is, 1. Property knowingly used by the owner in aiding insurrection; 2. Property purchased or acquired, sold or given, by the owner, or his agent or employé, with intent to aid insurrection; 3. Property which the owner consented to the use of, to aid insurrection; 4. Property which the owner consented to the use of, to aid, abet or promote persons engaged in insurrection; 5. Property which the owner suffered to be used to aid insurrection; 6. Property which the owner suffered to be used to aid persons engaged in aiding insurrection; 7. Property which the owner´s agent suffered to be used in aiding insurrection; 8. Property which the owner´s agent suffered to be used in aiding persons engaged in aiding insurrection. The Proceedings Not In Personam. The argument of several opposing counsel, that the act contemplates proceedings against persons, because the property to be confiscated is confined to that of the classes of persons mentioned in the act, may be briefly answered by referring to secs. 2 and 3, which provide for proceedings in rem.
