Excerpt from A Treatise on the Law of Awards In the progress of society, a considerable time elapses, after the ideas of property, and of the exclusive rights of the individual, have arisen in the minds of men, before a compulsory system of distributive justice can be completely established. During that unsettled period, every dispute, for the decision of which the passions of the disputants do not prompt them to appeal to the chance of arms, is terminated either by a mutual agreement, the conditions of which are settled by themselves, or by the intervention of their friends; or by a reference to some indifferent person, of whose superior wisdom and equity they have formed a favourable opinion. The security which each party has for performance by the other, in the first mode of settlement, arises partly from the nature of the agreement, which consists perhaps of mutual concessions to be made at the same time, partly from the fear of mutual violence in case of refusal, and partly from that sense of honour and respect for the opinion of others, which in every period of society has a considerable influence over the mind.
