The transfer of an estate in land is effected in the United States: 1. By voluntary conveyances by one person to another. 2. By descent under the laws of succession existing in the various states of the Union. 3. By a devise contained in a last Will and Testament. 4. By operation of law. We will consider only voluntary conveyances and a brief reference to their history and origin may aid you in your study of a rather technical subject. Our conveyances, like our common law, are of English origin and grew out of the Feudal System and the Statutes Mortmain, or to be more exact, through ingenious evasions of the latter statute.
