Excerpt from Outlines of the Law of Bailments and Carriers § 1. Definition. - Many attempts have been made to define a bailment but none is free from criticism. For our purpose it is enough to say that - A bailment is a contract relation resulting from the delivery of personal chattels by the owner, called the bailor, to a second person, called the bailee, for a specific purpose, upon the accomplishment of which the chattels are to be dealt with according to the owner´s direction. An analysis of this statement will make clear the primary principles applicable to the subject. § 2. Contractual relation. - The bailment relation is one of contract and the principles of contract law are applicable thereto.
