Excerpt from Opinions Delivered by the Judges of the Court of Appeals, on the Constitutionality of the Act of Congress Declaring Treasury Notes a Legal Tender for the Payment of Debts These causes, involving the validity of the act of congress declaring treasury notes a legal tender in payment of all debts, were argued together in the Court of Appeals, at the June term, 1863, by Messrs. Porter and Tremain, counsel for the plaintiffs in the first above entitled action, and by Messrs. Curtis and Doty for defendants; and by Messrs. Noyes and Roelker for plaintiff, in the second above entitled action, and by Mr. Curtis for defendant. At the opening of the court at the September term, 1863, judgments were pronounced in both cases, declaring the validity of the act of congress, all the judges concurring except Denio and Selden. The following are the opinions delivered: Opinion of Judge Davies. Davies, J. The respondents in the first above entitled cause are banking associations, organized under the general banking law of the State of New York, and the several acts amendatory thereof, and are located and doing business in the city of New York.
